1. Acceptance of Terms
By accessing or using this website (the "Site"), including the console demo and Support Portal, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Site.
2. Description of the Site
The Site provides information about Predator Defense Systems' autonomous defense platform, Solutions, and Services, an interactive console demo, and a Support Portal for existing and prospective customers.
Use of the underlying Predator platform by a customer is governed separately by that customer's Order Form and license or subscription agreement, not by these Terms.
3. The Console Demo
The console demo is an illustrative simulation built to demonstrate how the platform behaves. It does not process real production data, does not reflect a live customer environment, and any incident, metric, or scenario shown is illustrative rather than a report of an actual event.
4. Support Portal; Account Responsibilities
Access to the Support Portal is provided either through Account Access, using credentials issued in connection with an active contract, or Purchase Verification, for individuals verifying a recent purchase.
You are responsible for maintaining the confidentiality of any credentials and for all activity under your account. Notify us promptly of any suspected unauthorized use.
5. Acceptable Use
You agree not to:
- Access or attempt to access any portion of the Site you are not authorized to access;
- Interfere with, disrupt, or attempt to test the security of the Site in a manner not expressly authorized in writing;
- Scrape, harvest, or use automated means to collect data from the Site without our prior written consent;
- Upload malicious code or content that infringes the rights of others; or
- Misrepresent your identity or affiliation when submitting a support or contact request.
If you believe you have identified a security vulnerability in the Site, please report it to legal@predatordefense.systems.
6. Intellectual Property
The Site and its content, including text, graphics, logos, and the console demo, are owned by Predator Defense Systems or its licensors and are protected by intellectual property laws. Except as necessary to use the Site as intended, you may not copy, modify, distribute, or create derivative works from the Site's content without our prior written consent.
7. Disclaimers
THE SITE, INCLUDING THE CONSOLE DEMO, IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PREDATOR DEFENSE SYSTEMS DISCLAIMS ALL LIABILITY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, ITS CONTENT, OR ANY SERVICES PROVIDED THROUGH IT.
To the maximum extent permitted by law, Predator Defense Systems' total aggregate liability for any claim arising out of or relating to your use of the Site — under any legal or equitable theory — is limited to zero dollars ($0). This NIL-liability cap applies regardless of:
- the nature of the claim,
- the form of action,
- whether Predator Defense Systems was advised of the possibility of damages, or
- whether any other agreement provides a different liability structure for paying support customers.
Certain jurisdictions do not allow the exclusion or limitation of specific types of damages. In those jurisdictions, Predator Defense Systems' liability will be limited to the minimum extent permitted by applicable law.
9. Third-Party Links
The Site may contain links to third-party websites. We are not responsible for the content or practices of any linked site.
10. Governing Law
These Terms are governed by the laws of the United States of America, without regard to conflict-of-laws principles.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
